It is the document that delimits the Community of Owners from the material and legal point of view. It contains the description of the property, including its distribution by floors, dwellings, premises, common services and facilities, possible easements, etc., as well as the participation quota corresponding to each floor or premises in the building as a whole. It also usually, but not always, includes the bylaws, which constitute the Community’s operating regime.

The most common is that the constitutive title of the Horizontal Property is granted in a notarial public deed by the promoter of the building. It is called Escritura de División Horizontal (Deed of Horizontal Division) and is subject to registration in the Property Registry corresponding to the place where the building is located.
